These Terms of Service (“Terms”) govern your access to and use of the websites, platform, and applications provided by Xray Payment (“Xray Payment,” “we,” “us,” or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials and all activity under your account.
2. Use of the Services
You agree to use the Services only for lawful business purposes and in compliance with these Terms, applicable law, card-network rules, and any separate agreements you have with us (such as a Merchant Processing Agreement). You will not misuse the Services, interfere with their operation, attempt unauthorized access, or use them to transmit unlawful, infringing, or harmful content.
3. Merchant and payment services
Payment-processing services are provided under, and additionally governed by, your separate Merchant Processing Agreement and the terms of the applicable processors and sponsor banks. In the event of a conflict regarding payment services, those agreements control.
4. Connected accounts and third-party platforms
Our marketing features let you connect third-party accounts (such as Facebook, Instagram, LinkedIn, and X) to schedule and publish content. Your use of those platforms is governed by their own terms and policies. You are responsible for the content you publish and for having the rights to do so. We act only at your direction and are not responsible for third-party platforms’ availability, changes, or actions.
5. Intellectual property
The Services, including their software, design, and content (excluding your content), are owned by Xray Payment or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services as permitted by these Terms. You retain ownership of content you submit and grant us the rights needed to operate the Services.
6. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
7. Limitation of liability
To the fullest extent permitted by law, Xray Payment will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Services.
8. Termination
We may suspend or terminate access to the Services at any time for conduct that violates these Terms or applicable law, or to protect the Services. You may stop using the Services at any time.
9. Changes
We may update these Terms from time to time. Changes are effective when posted, indicated by the “Last updated” date above. Your continued use of the Services constitutes acceptance of the updated Terms.
